The Rachael Ray Foundation™ (RRF) supports causes near and dear to Rachael’s heart, with one simple idea mind: that businesses that do well should do good. Our mission is to help animals in need and to support Yum-o!-aligned organizations, along with others. RRF’s website, rachaelrayfoundation.org (the “website” or the “site”) contains information about RRF, its partners, and more. We strive to promote the online safety and privacy of our users. All materials sent to us either electronically or via regular mail will not be posted automatically and will be reviewed by us first. We will not post any materials without the user’s consent. At any time a user can request their materials be removed from the website by contacting us at [email protected].

RRF has implemented this Privacy Policy governing the personally identifiable information (“Personal Consumer Information”) collected by this site. This Privacy Policy does not govern Personal Consumer Information collected from any other source or in any other manner. This website is intended for use by U.S. residents.

CALIFORNIA PRIVACY RIGHTS

RRF does not provide your Personal Consumer Information to any third party for direct marketing purposes unless RRF obtains your prior written consent for such use. However if a company adopts and discloses a privacy policy that requires the company to obtain prior consent to disclose personal information to third parties for the third parties’ direct marketing purposes, then the company is not required to maintain and provide such lists, and instead may provide you with information on how to exercise your right to prevent disclosure of your personal information. Because the RRF policy as disclosed on this site requires RRF to obtain your consent to disclosures by RRF of your Personal Consumer Information to third parties for their direct marketing purposes, RRF does not have to provide you with such lists. COLLECTION OF INFORMATION

Information You Provide to Us

RRF collects information about you when you visit and interact with this website. Some of this information is automatically collected, and some is collected when you interact with the site. When you communicate with RRF electronically, via e-mail, when opting to receive our newsletter or otherwise, you consent to RRF’s use of the information you have provided, and you further consent to receive electronic communications from RRF. If, after consenting to RRF’s use of your information to send you electronic communications, you decide you would prefer not to receive such communications in the future, you can opt out of our email lists by either clicking on the “opt out” line at the bottom of the email, or by emailing us directly at [email protected].

SECURITY OF INFORMATION

RRF maintains reasonable standards of confidentiality and security for this site and the Personal Consumer Information collected from this site. The Personal Consumer Information you provide is secured using industry standard e-commerce security technology. RRF also restricts its own employees’ access to Personal Consumer Information. However, it is possible that someone may intercept or access communications, transmissions and/or Personal Consumer Information. In the event that RRF determines that there has been a security breach resulting the unauthorized disclosure of Personal Consumer Information to a third party, RRF will promptly notify consumers whose Personal Consumer Information it reasonably believes has been so disclosed by posting such information on the site and, if email contact is possible, then we would send an email notification with respect to the situation.

USE AND SHARING OF INFORMATION

The Personal Consumer Information collected by RRF may be used for any lawful purpose, with your consent.
Use of Personal Consumer Information by RRF: The Personal Consumer Information collected by RRF may be used by RRF for any lawful purpose, including to communicate with you, respond to your requests, and analyze and improve RRF’s websites, its business and/or its service to you. Should you choose to opt-in to one of our email lists, RRF may use your information to send you email newsletters, information about the organization such as new features, status of goals, new partnerships, programs, activities, events, fundraising efforts and miscellaneous updates. All email newsletters and other communications will provide you with an opportunity to opt out of receiving future issues of such newsletters. Retention of Personal Information

Personal Information is retained to deliver our services, to otherwise fulfill identified or apparent purposes, and for record-keeping. At some point RRF may elect to destroy, erase or anonymize your Personal Information. Once anonymized, RRF undertakes not to re-identify the information.

Information posted on the Site may continue to be displayed on this Site, or on any successor website for as long as the Site or any successor Site is available, and may be archived by third party Sites. You may request access to your Personal Information in order for it to be updated or removed by writing to [email protected]. To the extent permitted by applicable law, we reserve the right to refuse requests for the removal of Personal Information from the Site.

Sharing of User Content on the Site

When users send us stories, recipes, photos and/or other content (“User Content”), these materials may be posted on our site. When we display a child’s photo or artwork, or photos that show images of any children, we will only show a child’s first name and age, and then only with the consent of the child’s parent or legal guardian. We will not show any last names or addresses, including email and postal. We will not use any User Content without the prior written consent of the user. We will not return any User Content, including but not limited to photographs, once they have been sent to us.

Disclosure by RRF of Personal Consumer Information to Other Entities

Without restriction, RRF may disclose aggregated statistics about visitors to its site, along with specific information concerning individual visitors of its site that is not Personal Consumer Information, provided that no specific individual can be identified by the information so disclosed. RRF may sometimes seek to share the Personal Consumer Information it has collected with a third party, and may also sometimes seek to share such Personal Consumer Information with companies that are affiliated with RRF. RRF may sometimes use a third party to provide certain services on its behalf, such as sending e-mails or performing statistical analyses of activity on this website. Our Site also includes social media features, such as Instagram. GOVERNING LAW

This Privacy Policy shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute concerning this Privacy Policy or your use of this site shall be submitted to binding arbitration in New York within one (1) year from the date that the cause of action arose (or, if multiple cause of actions are involved, from the date that the first cause of action arose), with such arbitration conducted pursuant to the then prevailing rules of the American Arbitration Association. To the fullest extent permitted by law, no arbitration brought pursuant hereto shall be joined to any other action or any other arbitration initiated pursuant hereto. If any portion of this Privacy Policy is deemed unenforceable, unlawful or void by a Court of competent jurisdiction, then that portion of the Privacy Policy will be deemed severable and will not affect the enforceability or validity of the remaining portions of this Privacy Policy.
